Terms & Conditions
Company details: Legal entity name, company number, registered office, VAT number, and ICO registration (if applicable) are configured by administrators and shown when available. Until configured, treat references to the controller identity as incomplete placeholders — not invented registrations.
1. Agreement
These Terms govern access to Rackstead websites, control panel, APIs, and hosting services. By creating an account or completing an order you agree to these Terms, the Acceptable Use Policy, and (where applicable) the Refund & Cancellation Policy.
Governing law: England and Wales, unless Company Details specify otherwise after legal review. Courts of England and Wales have non-exclusive jurisdiction; consumers may also benefit from mandatory local consumer protections.
2. Eligibility and accounts
You must provide accurate registration information, keep credentials secure, and be capable of forming a binding contract. You are responsible for activity under your account. Notify us promptly of unauthorised access.
3. Ordering and provisioning
Services are ordered through the control panel. Fees shown at checkout apply for the selected billing cycle. Features marked "coming soon", preview, or metadata-only are not guaranteed production capabilities. Provisioning depends on available capacity, IP inventory, and node health.
4. Payments, wallet, renewals
- Prepaid wallet credit and/or configured payment providers (Stripe/PayPal when enabled) are used to pay for services.
- Recurring VPS and similar services renew automatically for the selected billing period unless cancelled or auto-renew is disabled where the product supports it.
- Failed payment or insufficient balance may lead to suspension after notice where practicable.
- Taxes/VAT: invoice VAT treatment depends on Rackstead's configured tax status and your billing details. Do not assume a VAT rate until Company Details and accounting setup are complete.
5. Services
VPS, domains, and related platform features operate as described in the control panel. Game hosting features may be gated until infrastructure requirements are met. Resource limits in your plan apply. IP addresses are allocated from our pools and may be reassigned after service termination according to our IPAM practices.
6. Customer content and security
You retain rights to your content. You grant Rackstead a limited licence to host, back up, and process content solely to operate the Services. You are responsible for securing guest OS credentials, SSH keys, application security, and lawful use of content. We provide platform controls (2FA, API keys, firewall features as available); you must use them appropriately.
7. Acceptable use, abuse, suspension
You must comply with the AUP. We may warn, restrict, suspend, or terminate services for AUP breaches, non-payment, legal risk, or security incidents, using proportionate steps where practicable. See also our Abuse Policy.
8. Backups and availability
Backup and snapshot features are provided as described in-product. Do not rely on Rackstead as your only backup. Availability targets are described in the SLA; unless a separate written commitment applies, the SLA is a service description, not an automatic credits guarantee for all customers.
9. Support and maintenance
Support is available via the control panel. We may perform planned maintenance and will aim to minimise disruption. Emergency maintenance may occur without prior notice when required for security or stability.
10. Refunds and cancellation
See Refunds & Cancellation. Consumer rights under UK law are not excluded where they cannot be excluded.
11. Liability
Nothing in these Terms excludes liability that cannot be limited under applicable law (including for death or personal injury caused by negligence, or fraud).
Subject to that: we are not liable for indirect or consequential loss (including lost profits, lost data, or business interruption) to the extent permitted by law. Our aggregate liability arising from the Services in any 12-month period is limited to the fees you paid for the affected service in the three months before the claim (or a higher amount if required by mandatory consumer law).
12. Changes
We may publish updated Terms as a new version. Material changes that require re-acceptance will be surfaced in the control panel.
